The No Political Enemies Act is designed to prevent the federal government from targeting individuals and organizations based on their political speech, criticism, or participation in political activities. The bill establishes that federal officials—including the President—cannot use government enforcement actions, investigations, or regulations as a way to punish or suppress constitutionally protected speech and expression.

Here's what this means in practical terms: If someone believes the government is investigating them, prosecuting them, or taking regulatory action against them primarily because of their political views or speech, they can now go to court and challenge it. The government would have to prove by clear and convincing evidence that their actions were based on legitimate, non-political reasons. If the government can't meet this burden, the case gets dismissed. Additionally, if someone wins such a case, the government has to pay their legal fees and court costs.

The bill also creates new protections: Federal officials can be sued for damages if they knowingly target someone based on protected speech, and people can seek court orders to stop government actions they believe are politically motivated. There's an important exception built in—the bill doesn't prevent the government from enforcing voting rights laws, election laws, or other statutes that directly regulate political participation itself. Finally, the bill requires the Justice Department to report quarterly to Congress about significant criminal investigations and prosecutions, including the reasoning behind decisions to pursue or decline cases.
