The SEEK HELP Act protects people from criminal prosecution and civil lawsuits when they call for emergency help during a drug overdose. If you witness someone overdosing or you're overdosing yourself, and you call 911, contact poison control, or seek medical help, you cannot be arrested or prosecuted for drug possession based solely on that call for help. This protection applies even if drugs are found on you at the time—as long as you're the one who sought the medical assistance in good faith.

The law also protects people who administer overdose-reversal drugs like naloxone (Narcan) from being sued if something goes wrong, unless they acted with gross negligence or intentional misconduct. However, these protections don't apply if you were already being arrested or searched by police for other reasons when help was called. The law does allow police to use other evidence against you for different crimes, and it doesn't prevent them from seizing drugs as evidence in cases involving other offenses.

To make sure people know about these protections, the bill requires the federal government to run public awareness campaigns and provides funding to states for training law enforcement officers and educating the public about these overdose Good Samaritan laws. Within two years, the government must also report back to Congress on how well these protections are working, whether they're actually encouraging people to call for help, and what impact they're having on overdose deaths and emergency room visits.
