This bill makes it a federal crime to carry a firearm at polling places and ballot-counting locations during federal elections. Specifically, it prohibits anyone from knowingly possessing a gun in or within 100 yards of any building where election workers are running polls or processing ballots for federal elections. The law applies to all federal elections—presidential, congressional, and any other federal races. There are some important exceptions: law enforcement officers and security guards on duty can carry guns, people can have firearms locked in their vehicles as long as they don't take them out, and people can legally possess guns in their own homes or businesses even if those happen to be near an election site. The bill creates two levels of penalties depending on the circumstances. If someone simply brings a gun to an election site without intending to use it in a crime, they face up to one year in prison and fines. If someone brings a gun with the intent to use it to commit a crime at the election site, the penalty increases to up to five years in prison. The bill also includes enhanced penalties for anyone who kills someone during a gun-related attack on an election site, treating it as murder or manslaughter under existing federal law.
