The tribe has been fighting in court since 2013 to secure water rights for their reservation and tribal members. This settlement gives the tribe the legal right to pump and use up to 20,000 acre-feet of groundwater per year from the Indio Subbasin (a major underground water source in the region). This water right is dated back to 1876-1877, meaning it has priority over water claims made by local water districts after that time. The tribe can use this water on their reservation for any lawful purpose, lease it to others for up to 99 years, or distribute it to individual tribal members who own land on the reservation. The settlement also resolves disputes about various water-related fees and taxes that the tribe and its members have been paying. In exchange for settling these claims, the federal government will establish a trust fund to help implement the agreement, transfer some federal land to the tribe, and sell some federal land to the Coachella Valley Water District. The water districts involved agree to cooperate with the tribe on water management through a memorandum of cooperation. This settlement ends all litigation between the parties and provides the tribe with a secure, long-term water supply for their community.
