The HELP Separated Children Act is designed to protect children when their parents are detained during immigration enforcement actions. Right now, when immigration officials arrest someone, there's often little coordination to ensure their children are cared for or that the parent can arrange for their safety. This bill changes that by requiring immigration officials to quickly identify whether a detained person is a parent, help them make phone calls to arrange childcare, and provide them with information about legal services and child welfare agencies.

The bill sets specific rules for how immigration enforcement should happen when children are present. Officers can't use excessive force in front of children, can't ask children to translate, and must allow parents to communicate with their children during the arrest when possible. If a parent can't arrange care within 48 hours, immigration officials must help figure out a solution and keep the parent informed. The bill also requires that detained parents get regular phone and video calls with their children, can participate in family court hearings about custody, and are placed in detention facilities close to where their children live whenever possible.

Additionally, the bill creates new oversight mechanisms. Immigration officials must appoint a national coordinator to track parental cases and ensure detained parents can comply with child welfare court orders. The government must collect detailed data every six months about how many detained immigrants are parents, how often they see their children, and whether they're eventually released or deported. Immigration officials are also told to consider the best interests of children when deciding whether to prosecute someone, transfer them to a distant facility, or release them. The bill requires training for all immigration enforcement personnel on how to handle these situations with minimal trauma to children.
