This bill cracks down on dishonest insurance agents and brokers who help people sign up for health plans through the Affordable Care Act's online marketplaces. The main problem it's trying to solve is fraud—when agents or brokers lie on enrollment applications, trick people into plans they didn't ask for, or submit fake information to get commissions they shouldn't receive.

The bill creates serious consequences for agents and brokers who commit fraud. If someone knowingly provides false information when enrolling you in a health plan, they can face fines up to $200,000 per person affected and potentially up to 10 years in prison. Even if they're just careless or negligent with information, they can be fined between $10,000 and $50,000 per person. These are real teeth in the law—much stronger penalties than existed before.

For consumers, the bill adds important protections. Before an agent or broker can get paid their commission, they have to prove they got your actual consent to enroll you in a plan. You'll get clear notifications whenever your coverage changes, and you'll be able to see who your agent is and what plan you're in through an easy-to-access website or phone line. If someone tries to enroll you without permission, you can't be kicked off your current plan without your say-so. The bill also requires agents and brokers to act in your best interest, not just their own financial interest.

The bill also regulates the marketing companies and organizations that work behind the scenes to sign people up. These companies now have to register with the government, submit their marketing materials for approval, and can't use confusing or misleading tactics. If they terminate an agent or broker, they have to report why. The government will audit agents and brokers based on complaints from consumers and suspicious enrollment patterns, then share findings with state insurance departments to catch and stop fraud.
