# Medical Innovation Act of 2024: What You Need to Know

This bill creates a new fee that pharmaceutical companies must pay if they've settled legal cases with the federal government and make blockbuster drugs. The money collected goes directly to fund medical research at the FDA and National Institutes of Health.

Here's how it works: If a drug company made over $1 billion in sales last year and settled a federal lawsuit or investigation within the past five years (for things like fraud, false claims, or drug safety violations), they'll owe a supplemental payment. The payment is calculated as a percentage of the company's net income, multiplied by how many blockbuster drugs they sell. The percentage ranges from 0.75% to 1.5% depending on how much money they had to pay in their settlement. For example, a company that settled for less than $500 million would pay 0.75% of their annual income, while one that settled for over $1 billion would pay 1.5%. The company only pays based on their largest settlement if they had multiple cases in the same year.

The bill specifically targets drugs that benefited from federal research funding—meaning the underlying science came from government-funded research, or the drug uses discoveries made by federally-funded scientists. This is meant to recoup some public investment when companies profit from taxpayer-funded breakthroughs. The collected money must be split between the FDA and NIH based on their current budget sizes, and it can only be used if Congress maintains or increases their regular funding. The money goes toward urgent medical research priorities, including FDA regulatory science work and NIH funding for innovative research, early-career scientists, and diseases that cost the government the most money through Medicare and Medicaid.

If a company doesn't pay what they owe, the government can pursue collection like any other debt, and their drug cannot be sold until the payment is made. The bill requires the government to publish a list each year showing which companies owe payments and how much, and to report back to Congress annually on how the money was spent.
