# Understanding the PBM Act of 2024

This bill tackles a growing problem in the pharmacy industry: when the same company owns both a pharmacy and a pharmacy benefit manager (PBM). To understand why this matters, imagine if the same company both sold you medicine and decided which medicines your insurance would cover and how much you'd pay. That's the conflict of interest this bill is trying to prevent.

A pharmacy benefit manager is essentially a middleman between insurance companies and pharmacies. They negotiate drug prices, manage which drugs are covered, and process prescription claims. When a large company owns both a PBM and pharmacies, critics argue it creates unfair advantages. The company could steer patients toward its own pharmacies, charge higher prices to competitors' pharmacies, or prioritize profits over patient care. This bill makes that arrangement illegal and requires companies currently doing this to sell off either their pharmacies or their PBM operations within three years.

If a company violates this rule, federal agencies like the Federal Trade Commission, the Department of Justice, or state attorneys general can take them to court. If found guilty, the company must stop the practice, sell off the conflicting business, and return any profits they made from the pharmacy during the violation period. That money would go into a fund to help communities that were overcharged. The bill also requires the FTC to create rules to enforce this law and gives federal agencies broad authority to review any sales that happen as a result of this requirement to make sure they actually improve competition and help consumers.
