# Water Infrastructure Subcontractor and Taxpayer Protection Act of 2025

This bill adds new financial safeguards to federal water infrastructure projects that receive government loans or funding. Specifically, it requires that construction projects funded through the Water Infrastructure Finance and Innovation Act (a federal program that helps pay for water system improvements) must have "payment and performance security" in place. In plain terms, this means contractors must post bonds or other financial guarantees to ensure they actually complete the work and pay their workers and suppliers.

The bill gives flexibility in how this protection works. If a state or local government already has its own requirements for contractors to post bonds or guarantees, the federal government will accept those—but only if they cover at least 50 percent of the total construction contract cost. If a state or local area doesn't have such requirements, or if their requirements are too weak, then federal rules kick in requiring contractors to post bonds under federal standards. These federal standards come from existing construction law and are designed to protect workers, suppliers, and taxpayers.

The practical effect is that subcontractors and workers on federally-funded water projects get better protection if they're not paid by the main contractor, since the bond money can be used to cover unpaid bills. Taxpayers also benefit because the financial guarantees make it less likely that projects will be abandoned halfway through or that the government will have to step in to finish incomplete work. For project managers and contractors, the main change is ensuring they have adequate bonding in place before work begins, which is already standard practice in most states but may be new in areas with weaker requirements.
