This bill changes how federal judges can sentence people who are primary caretakers for children, elderly parents, or disabled family members. Right now, when someone is convicted of a federal crime, judges follow sentencing guidelines that don't always account for the fact that the person might be the main person taking care of vulnerable family members. This bill tells judges they should consider community-based alternatives—like treatment programs, counseling, or job training—instead of prison time, but only for certain situations.

The key requirement is that the person must be a caretaker (someone who regularly takes care of a child, parent, or disabled family member) and the crime they committed cannot be a violent offense. So if someone is convicted of a non-violent federal crime like drug possession, fraud, or theft, and they're the primary person responsible for their kid's wellbeing or caring for an elderly parent, the judge now has the option to sentence them to community-based programming instead of prison. This programming could include drug or alcohol treatment, counseling, job training, education classes, or other services the judge thinks would help.

The practical effect is that some people who would have gone to prison might instead stay in their communities, complete treatment or training programs, and continue providing care for their family members. Community-Based Sentencing Alternatives for Caretakers Act of 2021 This bill requires sentencing courts to consider a community-based alternative sentence in the case of certain individuals who are caretakers (e.g., parents). Current law sets forth seven factors that sentencing courts must consider when imposing a sentence. This bill establishes a new, eighth factor that courts must consider when imposing a sentence on a caretaker for a nonviolent offense. Specifically, courts must consider a community-based alternative sentence, which is a sentence that may require the defendant to complete or participate in community-based programming, counseling, or treatment.
