Federal agencies constantly issue guidance documents to explain how they interpret and enforce laws. These documents tell businesses, nonprofits, and individuals what the government expects them to do. The problem, according to this bill, is that people often can't tell whether these guidance documents are actual legal requirements or just the agency's interpretation of what the law means. This bill requires agencies to put a clear disclaimer on the front page of their guidance documents stating that the guidance doesn't have the force of law and doesn't legally bind anyone—it's just meant to clarify what existing rules mean.

Right now, when an agency issues guidance, it can be confusing whether you're legally required to follow it or whether it's just advice. This confusion can lead people to over-comply with guidance that isn't actually mandatory, or to misunderstand their actual legal obligations. The bill addresses this by requiring a specific statement on every guidance document that says, in plain terms: "This document doesn't have the force and effect of law. It's just here to help you understand what the law or agency policies actually require." This statement must appear prominently on the first page where people will definitely see it.

The bill gives the Office of Management and Budget (OMB), which oversees federal agencies, 90 days to write detailed instructions on how agencies should implement this requirement. After that, all federal agencies have 30 days to start including these clarity statements on any new guidance they issue. Essentially, this is a transparency measure designed to make government guidance documents clearer and less likely to be mistaken for actual legal requirements. For everyday people and businesses dealing with federal agencies, it should make it easier to understand what they actually have to do versus what's just recommended practice.
