# The Jennifer Kepner HOPE Act: What It Does

This bill expands healthcare benefits for military veterans who were exposed to burn pits during their service. Burn pits are outdoor areas where the military disposed of waste by burning it in the open air—a common practice at military bases in Iraq, Afghanistan, and other locations where the U.S. military has operated since 1990. The smoke and fumes from these burn pits contain toxic chemicals and pollutants that many veterans believe have caused serious health problems.

The key change is that veterans who served at locations with burn pits can now receive hospital care, medical services, and nursing home care through the Department of Veterans Affairs without having to prove that their specific health condition was caused by the burn pit exposure. Normally, veterans need medical evidence showing a direct link between their condition and their military service to qualify for VA benefits. This bill removes that requirement for burn pit exposure, making it much easier for affected veterans to access care. Any veteran who was stationed at a base with an active burn pit since January 1, 1990, becomes eligible for these VA benefits.

This is significant because many veterans have developed respiratory problems, cancers, and other illnesses they attribute to burn pit exposure, but the medical evidence connecting specific diseases to burn pit smoke is still developing. By not requiring proof of causation, the bill ensures that veterans don't get stuck in a lengthy process trying to prove their illness came from the burn pit. Instead, they can access the healthcare they need now. The bill takes effect 180 days after it becomes law, giving the VA time to prepare its systems to handle the expanded eligibility.
