# The APEX Act: What It Does

The APEX Act gives the federal government's Commodity Futures Trading Commission (CFTC) the power to oversee how aluminum prices are set in financial markets. Right now, certain markets determine what's called the "aluminum premium"—basically an extra charge added to the base price of aluminum that affects what manufacturers and consumers ultimately pay. This bill says the CFTC can now watch over how these prices are determined, make sure the process is fair and transparent, and investigate whether anyone is manipulating the system unfairly.

To be clear, this bill doesn't let the government actually control or set aluminum prices themselves. Instead, it's about making sure the markets that determine these prices aren't rigged or operating in the shadows. The CFTC will have the authority to examine the process, demand transparency, and ensure the mechanism is legitimate. Aluminum Pricing Examination Act or the APEX Act This bill extends the jurisdiction of the Commodity Futures Trading Commission (CFTC) to include the markets for aluminum premiums. Specifically, the CFTC has jurisdiction over (1) the process and manner in which reference prices for such premiums are set or reported, and (2) whether the mechanism for setting such reference prices is fair and transparent. Additionally, the CFTC must consult with the Department of Justice regarding relevant information, including allegations of anticompetitive conduct.
