**The Fentanyl Crackdown**

The main part of this bill automatically makes any substance chemically similar to fentanyl illegal, even if it hasn't been specifically named yet. Here's why this matters: drug manufacturers constantly tweak fentanyl's chemical structure slightly to create new versions that technically aren't illegal under current law—a practice called "designer drugs." This bill closes that loophole by saying that anything structurally related to fentanyl through certain chemical modifications is automatically a Schedule I controlled substance (the most serious category). The Attorney General can publish a list of known fentanyl-related substances for clarity, but the law applies to unlisted ones too. This means law enforcement can prosecute people making or selling these knockoff versions without waiting for the government to officially add each new variant to the banned list.

**Making Research Easier**

Ironically, while cracking down on fentanyl use, the bill makes it simpler for legitimate researchers to study fentanyl and related substances. Currently, researchers need extensive approvals and separate registrations for each location and team member. This bill streamlines that process. Researchers working on FDA-approved drug trials or government-funded projects can now notify the Attorney General and start research within 30 to 45 days instead of waiting months. Multiple researchers at the same institution can work under one registration, and researchers can conduct studies across multiple nearby locations under a single approval. The bill also requires the Justice Department to report back within a year on how this expedited process is working for fentanyl research specifically.

Halt All Lethal Trafficking of Fentanyl Act or the HALT Fentanyl ActThis bill permanently places fentanyl-related substances as a class into schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act.Under the bill, offenses involving fentanyl-related substances are triggered by the same quantity thresholds and subject to the same penalties as offenses involving fentanyl analogues (e.g., offenses involving 100 grams or more trigger a 10-year mandatory minimum prison term).Additionally, the bill establishes a new, alternative registration process for certain schedule I research.The bill also makes several other changes to registration requirements for conducting research with controlled substances, including<ul><li>permitting a single registration for related research sites in certain circumstances,</li><li>waiving the requirement for a new inspection in certain situations, and</li><li>allowing a registered researcher to perform certain manufacturing activities with small quantities of a substance without obtaining a manufacturing registration.</li></ul>Finally, the bill expresses the sense that Congress agrees with the interpretation of Controlled Substances Act in United States v. McCray, a 2018 case decided by the U.S. District Court for the Western District of New York. In that case, the court held that butyryl fentanyl, a controlled substance, can be considered an analogue of fentanyl even though, under the Controlled Substances Act, the term controlled substance analogue specifically excludes a controlled substance.
