# Online Consumer Protection Act: What You Need to Know

This bill would require social media platforms and online marketplaces like Facebook, TikTok, Amazon, and eBay to be much more transparent about how they operate and to follow strict consumer protection rules. Essentially, it treats these companies like they need to follow the same kinds of consumer protection laws that apply to traditional businesses, and it gives the Federal Trade Commission (FTC) the power to enforce these rules.

The core requirement is that these platforms must publish clear, easy-to-understand terms of service written in plain language that anyone can actually read and comprehend. For social media platforms, these terms must spell out exactly what content is allowed or banned, how the company decides to remove posts or ban users, how you can appeal those decisions, and what tools exist if you're being harassed online. For online marketplaces, the terms must cover what products are allowed for sale, how the company handles reports of fraud or dangerous items, what refunds or remedies you're entitled to if something goes wrong, and how sellers can contest complaints against them. Both types of platforms would also need to appoint a consumer protection officer who reports directly to the CEO and must certify annually to the FTC that the company is following these rules.

The bill gives you real power to fight back if a platform violates these requirements. You could sue the company directly in court and recover actual damages plus attorney's fees if you win. Importantly, the bill says you can't be forced into secret arbitration or blocked from joining class-action lawsuits—you get your day in court. The FTC can also investigate and punish violations, and state attorneys general can bring enforcement actions on behalf of their residents. The bill also makes clear that platforms can't hide behind Section 230, a law that currently shields them from liability for user-generated content, when they violate these new consumer protection rules.
