# Made in America Emergency Preparedness Act: What You Need to Know

This bill creates a new national commission to study how America can better prepare for future emergencies like pandemics, and it requires the government to buy more medical and emergency supplies made in the United States. The commission will examine what went wrong during COVID-19, figure out which products are critical to have on hand during emergencies, and recommend ways states should prepare for future crises.

The bill establishes a 10-member commission made up of prominent citizens from fields like healthcare, manufacturing, emergency management, and business. This group will have 18 months to investigate the pandemic response, determine which medical products and supplies are essential for emergencies, and recommend what the federal government should stockpile. They'll also look at whether hospitals and medical centers have the infrastructure they need. Starting in 2026, the government will be required to buy critical medical, pharmaceutical, and emergency supplies only from American manufacturers when responding to declared national emergencies—unless the President or the commission decides an exception is necessary for national security reasons.

The bill also includes a financial incentive for companies that build or expand pharmaceutical and medical device manufacturing facilities in the United States. These companies can immediately write off 100 percent of their equipment costs on their taxes (instead of spreading the deduction over several years), which saves them money and encourages investment in domestic production. Additionally, states that don't implement the commission's recommendations by January 1, 2026, could lose federal emergency preparedness funding, though the Secretary of Homeland Security can grant exemptions to states making good-faith efforts to comply.

Made in America Emergency Preparedness Act This bill establishes in the legislative branch the National Commission on United States Preparedness for National Emergencies and requires any medical, pharmaceutical, or emergency preparedness product deemed integral to a response to a national emergency to be manufactured and procured in the United States beginning on and after January 1, 2026. The commission must, among other things, examine and report on the COVID-19 pandemic in the United States in 2020 and the private sector response, investigate the origin of the COVID-19 virus and measures for mitigating the impacts of future physical and medical national disasters, determine what medical, pharmaceutical, and emergency preparedness products are deemed to be essential to emergency preparedness, and report on infrastructure or capability deficiencies in hospitals and medical centers. States must implement the commission's findings or lose access to federal emergency preparedness funds. The bill allows 100% tax expensing for qualified pharmaceutical and medical device manufacturing property (e.g., personal protective equipment) placed in service after 2020 and before 2027.
