# College Athlete Economic Freedom Act: What It Actually Does

This bill gives college athletes the right to make money off their own names, images, and likenesses—basically their personal brand. Right now, colleges and athletic conferences can prevent athletes from earning money through endorsements, sponsorships, or other commercial deals. This bill would change that by saying colleges can't stop athletes from marketing themselves, whether individually or as a group.

Here's what would actually change: A star quarterback could sign endorsement deals with shoe companies, energy drink brands, or local businesses without losing their scholarship or eligibility. A women's soccer player could make money from social media sponsorships or appearance fees. Athletes could hire agents or lawyers to help negotiate these deals without getting in trouble with their school. The bill also prevents colleges from secretly coordinating with each other to keep athlete payments artificially low—basically outlawing a form of collusion that currently exists.

The bill includes important protections for fairness. If a college or athletic group provides support to help athletes market themselves, they have to make that support available equally to all athletes regardless of gender, race, or sport. This is meant to prevent situations where only star football and basketball players get help while other athletes are left out. The bill also requires organizations that help athletes make these deals to register with the Federal Trade Commission and report how many athletes they're helping and how much money is being distributed, broken down by gender, race, and sport.

For international students on athletic visas, the bill clarifies that they can also earn money from their name, image, and likeness without jeopardizing their visa status. The bill sets up enforcement through the Federal Trade Commission, meaning if colleges or conferences violate these rules, they could face penalties. Athletes who are harmed can also sue in federal court and recover damages plus attorney's fees. The bill also makes clear that state laws trying to restrict these rights won't apply—this is federal law that overrides state rules.
