This bill changes the rules for how colleges and universities get accredited—basically, how they get officially approved to operate and have their degrees recognized. Right now, accrediting agencies (the organizations that evaluate whether schools meet quality standards) can consider diversity and inclusion policies when deciding whether to accredit a school. This bill would prohibit accreditors from considering the racial, gender, or ethnic composition of a school's students, faculty, or staff when making accreditation decisions. It also prevents accreditors from looking at whether leadership positions or honors go to people from particular racial or ethnic backgrounds.

The bill adds a new requirement that accredited schools must protect "free inquiry"—meaning they need to follow either the First Amendment (for public universities) or their own written policies on free speech and academic freedom (for private schools). However, religious institutions get an exemption from this requirement. Schools controlled by religious organizations—whether that's a divinity school, a school requiring religious participation from students and faculty, or any school with a religious mission—don't have to comply with the free inquiry standard.

If an accrediting agency denies or removes a school's accreditation because the school violated these new rules, the school can sue the accreditor in federal court. This creates a legal consequence for accreditors that try to enforce diversity or inclusion standards in their accreditation process. The practical effect is that colleges would have more freedom to adopt whatever admissions, hiring, and recognition policies they want without accreditors being able to challenge them based on diversity considerations.
