# Fair Credit for Farmers Act of 2023: What It Actually Does

This bill is designed to help farmers and ranchers who are struggling financially by making it easier for them to get loans and by giving them temporary relief on existing debts. Think of it as a lifeline for agricultural borrowers who are having trouble keeping up with their payments or getting approved for new loans.

The most immediate help comes in the form of a two-year payment pause. If you're a farmer or rancher who's fallen behind on your payments or is financially distressed, the government will pause your loan payments (both principal and interest) for two years and then extend your repayment deadline by at least two more years. Even better, during those first two years, the interest rate on your direct farm loans drops to zero percent. This means you're not accumulating additional debt while you get back on your feet. The bill also requires lenders to waive fees for new loans given to beginning farmers, minority farmers, veterans, and low-income farmers.

Beyond immediate relief, the bill reforms how the government handles farm loans going forward. It prevents the government from using your home as collateral unless absolutely necessary—your primary residence should only be taken as security as a last resort. The bill also removes a barrier that previously prevented farmers who had received debt forgiveness in the past from getting new loans. Additionally, it requires the government to be much more transparent when denying loan applications, spelling out exactly which rules and regulations led to the rejection and providing instructions for how to appeal. If the government fails to list a reason for denying your loan, they can't use that reason against you later unless your situation has significantly changed.

The bill also strengthens the appeals process for farmers who believe they've been wrongly denied. For farmers earning less than $300,000 annually, the burden of proof shifts—the government now has to prove it was right to deny the loan, rather than the farmer having to prove the government was wrong. This is a significant change that levels the playing field for smaller operations.
