This bill is about making sure people who were harmed by nuclear radiation get fair compensation from the government. Back during the Cold War, the U.S. government conducted nuclear weapons tests, primarily in Nevada and other western states. Radioactive fallout from these tests drifted downwind and exposed people in surrounding communities to dangerous levels of radiation. Many of these people developed serious illnesses like cancer and thyroid disease as a result. The government already has a program called the Radiation Exposure Compensation Act that pays people who were affected, but this bill expands who qualifies for that help.

The main change is that the bill expands the geographic areas covered by the compensation program. Currently, only certain specific townships and counties are eligible to receive payments. This bill removes those geographic restrictions and includes all acreage in any county that was affected by the nuclear testing fallout. In practical terms, this means people living in additional communities who were exposed to radiation will now be able to apply for and receive compensation for their illnesses. The bill also extends the deadline for the compensation fund itself. The original program was set to expire after 22 years, but this bill extends it to 27 years, giving people more time to file claims and receive payments. This is particularly important because radiation-related illnesses can take years or even decades to develop, so people may not realize they're eligible until much later. By extending the fund's timeline, the bill ensures that people who get sick years after the initial exposure still have a chance to seek compensation from the government.

Downwinders Parity Act of 2021 This bill expands a program that compensates individuals who were exposed to radiation from atmospheric nuclear testing and subsequently developed specified cancers. It also extends for five additional years the Radiation Exposure Compensation Trust Fund. Under current law, the program compensates, among others, individuals who were present in a designated geographic area during a period of nuclear testing. The bill expands that area to include all parts of Clark County, Nevada, and Mohave County, Arizona. Current law restricts eligibility to certain parts of those counties.
