This bill creates a national system to track educators who have committed sexual misconduct and prevents them from being hired at other schools. Right now, there's no unified way to share information about teachers or staff members who have been disciplined or fired for sexual abuse, grooming, or other inappropriate behavior with students. This means someone fired from one school for misconduct could potentially get hired at another school in a different state without the new employer knowing about their past. The bill addresses this by establishing a National Educator Misconduct and Discipline Registry (NEMDR) that schools and school districts must use when hiring anyone who will have contact with students. Schools and districts are required to report any findings of sexual misconduct, terminations, or resignations during investigations to both their state education agency and the national registry within 48 hours. The bill also creates a Federal Task Force made up of education officials, law enforcement, and child protection experts to analyze the data, identify patterns and weaknesses in how schools handle these cases, and provide recommendations to Congress and states. Schools that don't comply with reporting requirements could lose federal education funding, and the bill specifically prohibits schools from making secret agreements that hide misconduct information—a practice sometimes called 'passing the trash.'
