This bill aims to increase transparency in how the Supreme Court handles emergency requests for temporary court orders (called preliminary injunctions and stays). Right now, the Supreme Court can issue these orders very quickly with little or no explanation—a practice sometimes called the "shadow docket" because it happens behind the scenes without much public visibility. This bill would require the Supreme Court to publish written explanations whenever it grants, denies, or cancels these emergency orders, and to publicly disclose how each justice voted on the decision. When the Court issues an order about preliminary injunctive relief, it must explain its reasoning on four specific points: whether the person asking for relief is likely to win their case, whether they'll suffer serious harm without the order, whether the balance of fairness favors them, and whether the order serves the public interest. For orders about staying (pausing) preliminary injunctions, the Court must address similar criteria tailored to that type of request. The bill doesn't change the legal standards the Court uses to decide these cases—it just requires the Court to show its work publicly. The Federal Judicial Center will report to Congress every two years on whether the Supreme Court is complying with these new transparency requirements.
