The AI OVERWATCH Act is a law that controls the export of advanced computer chips to countries the U.S. considers security threats: China, Cuba, Iran, North Korea, Russia, and Venezuela. These restrictions apply to powerful chips used in artificial intelligence and data centers—basically the high-performance processors that power AI systems.

Here's how it works: If a U.S. company wants to sell these advanced chips to anyone in these countries, they now need a special license from the Commerce Department. Before approving any license, the government must notify Congress and wait 30 days. During that time, Congress can block the sale by voting to reject it. The government also has to prove that the sale won't hurt America's AI advantage, won't reduce chip supplies for U.S. companies, and includes safeguards so the chips don't end up helping those countries' militaries or intelligence agencies.

The law creates an exception for trusted American companies that meet strict requirements. These companies can export chips to non-threatening countries without a license, as long as they keep the chips under American control, maintain strong security, don't let foreign entities own more than 10 percent of their company, and keep most of their chip operations in the United States. The government also has to develop a national security strategy explaining why these restrictions matter and how they protect America's technological leadership in artificial intelligence.
