The bill also limits what a judge can do if they find the government made a mistake when issuing the permit. Instead of canceling the permit outright, judges would have to send the case back to the government agency to fix the problem and try again. A judge could only shut down or block a permit if they determine that the activities it allows would create an immediate and serious danger to human health or the environment with no other way to fix it. Once a judge sends a case back, the government has up to 180 days to address the court's concerns and reissue the permit.

In practical terms, this makes it much harder for environmental groups, landowners, and concerned citizens to challenge permits through the courts. The 60-day deadline is quite short—many people won't even know a permit was issued in that timeframe. The restrictions on what judges can do also favor permit holders, since even if a court finds problems, the permit keeps operating while the government fixes things.
