This bill addresses a problem that can make things even worse: while you're being held captive, tax deadlines keep passing, and the IRS can charge penalties and interest on unpaid taxes—even though you're unable to handle your finances or file returns.

This bill essentially pauses your tax obligations while you're being held hostage or wrongfully detained abroad. The time you're detained doesn't count toward tax deadlines, so you won't face penalties or interest charges for missing filing dates or payment deadlines during that period. If you were already charged penalties and interest before the government officially recognized your situation, the IRS will refund or cancel those charges. The same protections apply to your spouse, so if you're married, they get relief too.

The bill also creates a formal program where hostages and wrongfully detained Americans—or their family members—can apply for refunds of any penalties, interest, or fines they already paid during their detention. The government has until January 1, 2025, to set up this program and identify who qualifies. Once identified, eligible individuals will be notified and given a year to apply for their refunds. This covers anyone detained or held hostage from January 1, 2021, onward. The State Department and the Hostage Recovery Fusion Cell will maintain lists of qualifying individuals to help the IRS identify who's eligible.

Essentially, this bill recognizes that Americans held captive shouldn't face financial punishment from their own government for circumstances completely beyond their control. It removes the tax burden that piles up during captivity and compensates those who already paid penalties they shouldn't have owed in the first place.
