This bill makes it easier and more financially attractive to build affordable housing near public transportation. It does this by boosting a federal tax credit that developers use to fund low-income housing projects. Essentially, the government is saying: "If you build affordable apartments near a bus station, train station, or waterway terminal, we'll give you a bigger tax break to help cover your costs."

The main change increases the tax credit by 80 percent for new affordable housing buildings located within half a mile of public transit in areas zoned for higher-density development. For existing buildings being renovated into affordable housing, the credit also increases by 80 percent. However, this benefit only applies to areas that local housing agencies specifically designate as transit-oriented development zones, and they can only designate up to 20 percent of their region's population areas this way. This prevents the incentive from being spread too thin across entire cities.

The bill also gives special treatment to Hawaii, Alaska, and U.S. territories like Puerto Rico and Guam. These places face higher construction costs due to their geography and distance from the mainland, so they get an even bigger boost—a 70 percent increase in the tax credit instead of the standard amounts. Additionally, the bill requires the Department of Housing and Urban Development to study how living costs vary across different regions and near transit access, then recommend ways to adjust how tax credits are distributed to states to account for these differences.

The practical effect is that developers will have stronger financial incentives to build affordable housing in walkable neighborhoods near public transportation rather than in car-dependent areas. This could help lower-income people access jobs and services more easily while reducing sprawl, though the actual impact depends on whether developers take advantage of these incentives and whether local governments designate enough transit-oriented areas to make a real difference.

Transit Oriented Development Act of 2022 This bill increases the low-income housing tax credit for buildings in transit-oriented development areas. The bill defines a transit-oriented development area as a designated area located within 1/2 mile from a rail, bus, harbor, or waterway station and zoned for high density. It also provides for an increase in the credit for buildings in high cost areas in non-contiguous states (i.e., Alaska and Hawaii) and U.S. possessions. The bill directs the Department of Housing and Urban Development to study cost-of-living differences throughout the United States based on geographic location and proximity and accessibility to transit.
