This bill makes major changes to how workplace disputes get resolved by severely limiting forced arbitration agreements. Right now, many employers require workers to sign agreements saying that if a problem arises—like wage theft, discrimination, or unsafe conditions—the worker must go through private arbitration instead of being able to sue in court or join together with other workers in a class action lawsuit. This bill essentially bans that practice for new disputes.

The core restriction is straightforward: employers can no longer require workers to sign arbitration agreements *before* a problem happens. If you're hired and your employment contract includes a clause saying you must arbitrate any future disputes, that clause becomes unenforceable under this law. The bill also prohibits "class action waivers"—agreements that prevent workers from joining together to pursue claims as a group. These waivers are banned entirely before a dispute arises, and after a dispute arises, they're only allowed if workers voluntarily agree to them with full knowledge of what they're giving up. The bill also makes it illegal for employers to punish or threaten workers who refuse to sign these agreements.

For agreements workers sign *after* a dispute has already happened, the bill sets strict requirements to ensure they're truly voluntary. Workers must get the agreement in plain language, have 45 days to think it over, and must actively sign off on it in writing. During that 45-day waiting period, the clock stops on any time limits for filing claims. If an employer violates these rules—particularly by retaliating against a worker for refusing to arbitrate—the worker can sue in federal court and recover attorney's fees and damages.

The bill also strengthens workers' rights under the National Labor Relations Act by making it illegal for employers to force workers to waive their right to engage in "concerted activity," which means workers acting together to address workplace issues. Importantly, the bill applies broadly to all workers, including independent contractors, and covers all types of workplace disputes including wage and hour violations, discrimination, safety issues, and collective claims. Agreements between employers and labor unions are handled differently and aren't affected by most of these restrictions.
