The ANTE Act (Axing Nonmarket Tariff Evasion Act) gives the U.S. Trade Representative new power to stop companies from dodging tariffs by moving production to other countries. Here's how it works: When the U.S. puts tariffs on products from countries like China that don't have market-based economies, some companies try to get around those tariffs by setting up factories in third countries instead. This bill lets the Trade Representative investigate whether companies are doing this and, if they find evidence, impose the same tariffs on goods made in those third countries. The investigation can happen even before a company starts production if there are clear plans to do so.

The bill defines which companies can be targeted—mainly those owned or controlled by nonmarket economy countries, or where at least 25% of the company is owned by entities from those countries. The Trade Representative can start an investigation on their own, or Congress and other interested parties can request one. Once an investigation starts, the Trade Representative has 180 days to decide if duty evasion is happening. If they find it is, they can impose tariffs on the goods produced in the third country, matching the tariffs that would apply to products from the original nonmarket economy country.

For ordinary people, this could mean higher prices on some imported goods if companies can't avoid tariffs as easily, but it's designed to protect American workers and manufacturers from unfair competition. The tariffs stay in place as long as the original tariffs on the nonmarket economy country remain in effect, or until that country no longer controls the investment, whichever comes first.
