The FAMILY Act creates a national paid family and medical leave insurance program run through Social Security. Here's what it does: If you need to take time off work for qualifying reasons—like caring for a seriously ill family member, dealing with your own serious health condition, bonding with a new child, or escaping domestic violence—you can receive partial wage replacement payments from the federal government.

To qualify, you need to have earned at least $2,000 in wages or self-employment income during a recent 8-quarter period. Once eligible, you can take up to 12 weeks of leave per year (based on your normal work hours) and receive between 50-85% of your average monthly earnings, depending on your income level. The maximum monthly benefit starts at $4,000 in the first year, with minimums around $580. You'd file applications and monthly reports with Social Security, which has 20 days to process payments.

The law protects you from retaliation—your employer can't fire you, demote you, or punish you for taking this leave. They must restore you to your same job or an equivalent position when you return, and they have to maintain your health insurance during your leave. If your employer violates these protections, you can sue for lost wages, damages, and attorney's fees. States that already have their own paid leave programs (called "legacy states") can continue running those instead and receive federal grants to help cover costs, as long as their programs meet minimum standards of at least 12 weeks of leave per year with comparable wage replacement rates.
